I'm not sure all of it is necessary, nor that we should necessarily advocate for allowing building between 45' and 75' from lake shores. (Remember this is a compromise result of nine perspectives). The key ideas I think are important are:
1. Require a riparian buffer of at least 25' for new development.
2. Require that footprints be limited within the 75' setback. We suggest 20%. That would apply to pavement, gazebos, sheds, decks, and, if residential construction becomes legal, homes.
Those two will do a lot to reduce impacts to habitat and water quality and viewsheds.
The other key things that need to be done:
1. Come up with a way to alert people of the regulations. This addresses the unfortunate situations of people building in the setback because they weren't aware of the regulations.The ordinance does this through a land use permit that would apply to any mechanical clearing in the 75' setback. I think a note (link or bullet point) on the postcards of property assessments and property tax notices would be sufficient. I'm open to ideas!
2. Enforce the regulations. This addresses the people that knowingly build in the setback. This means the Assembly would need to fund more code compliance officers and give up its stance of "we won't sue borough residents".
